Incoterms® – what can we learn from case law?

Incoterms® 2020 set out the obligations of both sellers and buyers in parallel, including general obligations, delivery, transport, insurance, export clearance, packaging, and cost allocation. A proper understanding and correct use of Incoterms® is therefore essential to avoid disputes and ensure clarity in international trade transactions.
Case law provides practical insights into the pitfalls that may arise when Incoterms® are incorporated into sales contracts and applied in practice.

Barbara Bonafini

Barbara Bonafini is a lawyer specialising in international trade and customs law, with extensive experience providing advice and assistance on contracts related to international trade. She is a lecturer at the Master in International Trade Law at ITCILO (International Training Centre of the ILO) and an author and co-author of publications on international trade law and EU law.

Kevin Shakespeare
Kevin Shakespeare is the Director of Strategic Projects and International Development at The Institute of Export & International Trade (IOE&IT), the UK. The Director of the IOE&IT Academy and an approved UN international trade trainer, Kevin has developed several of the IOE&IT’s educational and training programmes including the Diploma in World Customs Compliance and Regulation. He has worked on trade initiatives with Invest NI, Scottish Enterprise, UK Export Finance, Saudi Export Development Authority, among others, and is also the dean of the UK Customs Academy and NI Customs and Trade Academy.
