Rules of Origin in focus: EU-UK TCA, EU-Mercosur ITA & supplier declarations

This roundtable brings together essential topics in the world of preferential trade and Rules of Origin compliance.

First, we will explore the EU-UK Trade and Cooperation Agreement through the lens of second-hand textiles, examining the challenges faced by customs administrations on both sides in aligning their interpretations of Rules of Origin - and what this means in practice for traders in the sector. As background, we will consider a Supreme Court ruling from one member state which ruled against a trader, and reflect on the broader implications this carries for preferential origin disputes.

We will then turn to the latest EU-Mercosur developments, most notably the temporary application of the Interim Agreement on Trade as of 1st May. We will outline the key origin requirements that apply to traded goods and draw attention to the practical challenges businesses are likely to face as they adapt to this landmark change.

Finally, using the EU-Mercosur Interim Agreement on Trade as a starting point, we will broaden the discussion to examine how supplier declaration requirements vary across different trade agreements and regions. We will highlight the most common errors businesses make and share practical insights on building robust processes to manage declarations effectively and remain audit-ready.

Marc Bauer advises companies worldwide on foreign trade topics, including customs procedures, trade facilitation, export controls, origin rules, and trade compliance. He also delivers specialist seminars, oversees the chamber’s documentary services (including certificates of origin and ATA carnets), and contributes to publications and online resources. In addition, he is active in the DIHK origin commission and the ICC Commission on Customs and Trade Facilitation, and supports international cooperation projects with partner chambers in countries such as Turkey, Argentina, and China.
